General terms of promotional campaigns

Running promotional campaigns is a popular and effective way among marketers to attract consumer interest. Such campaigns have an undeniably positive marketing effect, but non-compliance of their terms with the mandatory requirements of the Law on Protection of Competition and the Law on Consumer Protection entails serious risks of sanctions by the Commission for the Protection of Competition and/or the Commission for the Protection of Consumers. There are a number of regulatory restrictions regarding the value of prizes awarded, the mechanism for determining discounts, etc. If they are not observed, the conduct of a given campaign could be categorized as unfair competition and unfair attraction of customers, which could lead to the imposition of sanctions in serious amounts, reaching up to 10% of the total turnover of the offending enterprise.

Our team can prepare for you General Terms and Conditions for a promotional campaign, which will be in line with the legal requirements and the goals of the specific campaign.
